    I 140 Denied + H1 Expired + New Perm

    Hi All,

    I am very worried as my I140-EB2 got denied in Nov 2011. They(my company) re-filed a new one in Dec. My H1 expired in Dec. They replied to the H1 RFE in Nov which is still pending. With this newly filed Perm can I use the old Priority date? What happens if the H1 extension is denied?

    H1 expired in the sense my 6years over.
