    Traffic violation

    The new N-400 requires us to disclose even traffic offenses. I have got a reckless driving ticket (83 MPH on 65 MPH road) and a stop sign
    violation in the past. I located the reckless driving one and ordered a copy of certiified court disposition document and I am looking for the
    stop sign one ( I don't forgot which court )

    I still have a couple of questions aboput traffic violations

    (1) Is reckless driving beyond ordinary traiffic violations so that I should have disclosed it on I-485?

    (2) What about parking tickets? I don't know where to search for them.

    Moving violations only not parking tickets

    I believe you only need to list your mocing violations.

    you can request a copy of your dricing record from your State DPS. List everything on that DPS record.

    The question on the old N-400 is something like
    "Have you ever been arrested, cited, fined, imprisioned
    violation of any law or ordinances exclduing traffic violations".

    Township issues ordinances about parking and if you get
    fined, then you get fined.

    On the new N-400, the question is broken down into
    many small ones and none of which is about being fined
    for violation of ordiannces.

    Parking ticket is not issued for any _NAMED_ person
    but for cars. So I think may be it is OK not to disclose
    parking ticket.

    By the way, I think the current method of issuing parking
    tickets violate the constittion. It does not give us
    a right to challenge the ticket in court. The correct method
    shoudl be for meterlady to wait until the owner of teh car
    to arrive, then issue him a citation after establishing the identity.
    But now, we have no choice but to pay.

    He does say that you need to list all moving violations but not parking tickets.

    I don't think traffic violation (moving) commiited in Massachussetts, Florida, Oregon and a few others
    need to be disclosed because these states completely
    de-criminalized ordinary traffic offense. In these states,
    traffic violation is pure civil lawsuit matter between you
    and the state but we don't need to disclose civil violations.

    At least yoou would generate fewer Yes response if
    your ticket was issues in Massachussetts. For the
    example, you may still consider yourself being "cited"
    for civil vioilation but you can never be convicted.
    In Massachusstes, you will be found liable or not
    liable for the offense you made, but never guilty or not
    guilty so that you don't have to say Yes to "Have you
    ever been charged with with any crime or offense?"
    or "Have you ever been charged for any crime or offense".

    You got reckless for 18 MPH over?????? Wow in FL I got no points and no fines (only court fees + legal fees) for 67 in a 45 zone which is 22MPH. Did you try to fight it? Reckless driving sound way too hars for me for 18MPH over.

    I never check the actual statute I was cited for.
    That day, court was very crowded and the judge
    made an announcement to everyone, saying "If
    you pay the fine, this would not be on yoru record".
    So everyone waiting for a trial hurried to pay the fine
    and left including me.

    The court document I ordered has not arrived yet
    so I don't know what it says.

    As I said, in FLorida, triaffic violations are purely
    civil lawsuit matters, so your case can not be compared to
    mine for the purpose of I & N.

    The cop who stopped me also write "Caucassian"
    on the race check box because I was not black.

    The document arrived---it says my plea was no contest
    and the judge ordered teh case to be dismissed.

    Now I feel puzzled. I paid the fine. How come
    a defendent paid the file if teh case was dismissed?

    Is that fine civil penalty or criminal penalty?

    The fine was not recorded on the document
