POE question

Hi everyone , I post my issue time ago but since it was not clear i had to go ahead with the lawyer in charge of my case.
Last year i was changing status from a B1/B2 visa to an L1-B while in the united states I got 6 months while my company in my country processed the petition. in Nov 28 my I-94 expired but I was under the Lawfully presence since the change of status was going on with the USCIS. For personal and medical problems I had to quit the process and return to my country 10 days later the I-94 expired. My lawyer in the US told me if I wanted to return for vacations I will need to re apply for a new visitor visa since mine will be voided since i stayed 10 days
more. He finalyl sent out me all the documents that proves I did all legally for a change to apply for a new visa. My appoiment is for September 30. I also carry a swiss passport but I really want to get back my visa that was supouse to expire in 2013 now need new one. My question is , is I get a new visa granted at the consulate,
when traveling back (planning to go ending october or first days of november) What can I expect at POE? I did not vioalte any law , and i Have All the documents with me to prove what Im saying and since my lawyer told me to ge tback need a new visa , What are th chances from being admited /denied? What are the chances of using my my swiss pasport? My ESTA was approved. Can I always do the issuance of my other passport in case one visa its not accepted? Im not clear at this point , my lawyer does not give me clears answsers since i have not commercial dealing with ahim anymore. Someone?
