With H1B Ammend + new LCA, when can I move?

    Hi everyone,

I've been researching this forum, but want to file a new thread to somewhat confirm the bits of info I have found.

My situation: New job with same employer with slightly different description ( < 51%) in a different state. Lawyers are in the process of filing a new LCA for the new location and doing an H1B ammendment.

My question is: When can I move and start working at the new location?
    - When LCA is filed?
    - When LCA is approved?
    - When H1B is filed (and receipt noticed is issued)?
    - When H1B is approved?

It's important to know because it will determine if I (out of my own pocket) pay for premium processing or not (I wouldn't pay for PP if I can move if "H1B is filed" is ok to move)

    Thanks.

    - When LCA is filed?
-----LCA is filed for H1 and US employer can file any day
    - When LCA is approved?
---------------- After LCA is filed properly
    - When H1B is filed (and receipt noticed is issued)?
--------- When US employer wants to file H1 for somebody who is eligible for H1. Receipt Notice is issued by USCIS in 12-15 days AFTER H1 Petition reach the USCIS will all the required documents and correct fees.
    - When H1B is approved?
----- When the USCIS officer looks at file/H1 petition and thinks can be approved.

------------------- You should NOT pay any Fees for H1.
    Thanks.

    Hi ginnu,

Sorry, I wasn't clear. I was giving a list of multiple choices for my question of 'when can I move'? At what point among those 4 choices:

    - LCA has been filed
    - LCA has been approved
    - H1B has been filed (and receipt noticed issued)
    - H1B has been approved

    Thanks for clarifying.

    Igor

    Hi,
Just wondering, did you ever get an answer to this question somewhere else? I'm in a very similar situation and wondering if I can move once the LCA has been filed.

    Thanks.
