    Post H4 to H1 conversion

    Hi,

    I am presently in India and recently got my H4 stamped. I am planning to move to US next month (July, 2011) and thinking of getting my present visa converted to H1 after going there.

    My doubt is should I be there in US for 6 months(or say some x months time) and then only be eligible for applying to H1B from H4.

    Please kindly suggest....

    Employer Petition

    In order to change your status from H4 to H1 you need a employer petition.
