Thread: H1B - EAD (I485) Question

    Question H1B - EAD (I485) Question

My Current Visa Status is H1B and I also have an EAD - both from company "ABC". My H1B visa is expiring in a couple of years. I have a two part question:

    a. I would like to know if I start using EAD, what happens to my H1B with company "ABC". Will they cancel it? Once on EAD, how am I associated with the company ("ABC").
    b. Can I get married (to somebody living in India) while I am on EAD (I presume this is not possible)? In case I cannot get married while on EAD, can I go back to my H1B status with company "ABC" and get married?

------------------Your EAD or AP is not based on company"ABC" EAD, AP are based on your pending I-485 and I-485 is your petition.

-----------------------Once you use EAD your H1 gets invalidated and you are not on H1 status.

    b. Can I get married (to somebody living in India) while I am on EAD (I presume this is not possible)? In case I cannot get married while on EAD, can I go back to my H1B status with company "ABC" and get married?
If you use EAD then you are not on H 1 status and can’t bring your spouse on H4 status. You can get married any time H1 or EAD have no restriction on your marriage. Best option is to remain on H1 get married and bring your wife on H4 status and once your PD again becomes current then she file her I-485. You should remain on H1 status and your wife on H4 status to file her I-485 when your PD is current again. If you use EAD then you will not be on H1 status and can’t bring her on H4 status.
