    You need to file a lawsuit and you need to talk to LAZYCIS, one of our members. Once you file your lawsuit you will be probably done within a couple of months.-

    FBI and USCIS recently claimed they have processes all name checks pending more than 6 months. Did USCIS inform you that the name check was pending during your last inquiry? Have you moved since you started the process?

    My case is similar to yours, except that the dates are couple weeks earlier than yours. I received my interview letter on 3/12 with the interview date on 4/9. I had called them around 3/10 and they had initiated a Service Request. I don't know if that helped or not but the interview letter got sent out soon after that.

    So I think you are going to get your interview letter pretty soon depending on your local office. Just hang in there...

    Try to write to them: Supervisor, Naturalization Unit/Dept, PO Box 648005, Lee Summit, MO 64064, I was given this address when I had an infopass a month ago, it seems worked for me twice. In the meantime, open up a service request through 1-800 number.

    Thanks to you all guys. I am going to wait for next 30 days and meanwhile I am going to write a letter to Naturalization Supervisor @ National Benefit Center. Ya, I did got a response from San Jose DO, they said, they don't have my file, its still with NBC. Now I am stuck over 14 months. I called and spoke to level two, he said my name is still pending. I asked him, about the USCIS web posting claiming all name checks has been cleared, but he said "Yes all but not yours yet". He said all you can do is wait/wait/wait................

    my local office called me yesterday and told me not to come to the interview because my name check was not cleared. I asked if I could do the interview and be approved after the name check is received. The office stated that is impossible since the 120 days clock will start if he did the interview. It seems this is a new procedure to avoid court issue. Is it possible for people with de scheduled interview to sue later on even though the interview has not taken place yet?

    It has been in place since since 2007 not to schedule interview before name checks clear.

    Yes, if the name check has been pending for over about 8-12 months you would be able to sue via WOM. In your case, you're still early in the process and name checks are clearing under 6 months now, so you'll have to sit tight for a couple of more months.

    I have just call USCIS Press Dept in Washinton DC and left a message for Director of Communication to contact me, because its a false info on USCIS web site that all name checks pending over 180 days are completed. There are many applicants who are still waiting for name check to be cleared.

    Goto the sticky thread " Sample Complaint Letters to US Govt Officials" and start writing to everyone. It's 10 letters times 42 cents equals $4,20 and wait for the results.

    Nothing is going to happen unless you get out of the USCIS loop. Sometimes you have got do the right thing, write the letters, wait for the response, and use the evidence in court. -

    Again, FILE the lawsuit. You'll be done in 3 months.

    Just got a call from USCIS Press officer, she mentioned that FBI have done their part by getting those reports back to us, but we still need to work on the files so, they can be forwarded to DO for interviews.

    In other words, FBI is done with their name check backlogs, but USCIS still has it's own backlogs.

    Don't let them fool you. They are done electronically and on the spot. Unless they are doing an ICE and/or National Security investigation on you, which I seriously doubt because you wouldn't be on this spot. You are sitting on the twilight zone. Meaning nowhere.

    That is why, it is necessary to bring a third party into the equation and that person is the FEDERAL JUDGE. Nobody and I mean nobody, not even the AUSA (US attorney ) can play with it, or they will be held in contempt, which is never going to happen. Either they give you a DENIAL which they would have probably done if they had wanted to OR they tell the judge some macarroni BS that the JUDGE is not going to buy, therefore ORDERING them to get their act together and grant you the INTERVIEW and OATH right away.

    This is AMERICA and AMERICANS fight for their rights not only here but for those that do not have any elsewhere around the world. The same govt that fights for your rights elsewhere can sometimes deprive you momentarily of due process. That's what lawsuits are all about, to remind them about their place in society and to remind them who the MASTER is, the PEOPLE.-

    Sorry for the joke at your expense,, I am at the slowest DO of all, Seattle.

    But I think ( purely my stereotypical mind) certain religious names do take some time more than a John Smith/Marry Jane. If your name ends with Ata, Islam,, you may have to wait longer than a Jane Doe. Again, this is my opinion and bias.

    Per USCIS and the FBI memo, the process time should be less than 3 months by 4/31/2009. My name check will hit 5 months by that time. I think I could file WOM if my name check is not cleared by then.

    I second that. See my time line. About a month after I filed my WOM with the help of Lazycis, Jefkorn and Cregan, USCIS moved my application along and got my interview. I passed my interview but they could not give me a decision since my A-File is missing . At least I got the 120 days clock ticking. Do not wait longer, get your WOM filed and magic will happen. Good Luck
