How do we determine the PD?
is the Labor filing date? or I485 filing date?
My case was first applied in Oct 2001 from CA
later filed again on 16 Dec 2003 from NC
case moved to Backlog centers....funny is CA case moved to Dallas and NC case moved to Philly
Once Labor is cleared from Philly, company cancelled the case filed in CA (my bad...seniority is gone)
    filed I140 and 485 concurrently on 07/02/2007
    I140 approved in 09/04/2008
    FP done on 10/23/2008
    EAD approved untill 10/2008, 10/31/2010

so my PD is 07/02/2007 or 12/2003?
    Appreciate your update....Thanks.

  8. #8
PD is the date your Labor is applied. so it would be 12/2003

Does your 485 only become "pending" status if you file after your PD becomes current?

What if I were to file ahead of the PD date, would it still be considered "pending" so that after 180 days I could change employers?

Mine is more than 2484 days

    My PD is 10/22/2002
    I-140 - AD is 10/24/2004
    I485 - 12/20/2004

    Trying to figure this out.

    I-140 file 7/31/2003
    Visa became available 8/1/2003
    I-140 approved 5/7/2007
    I-485 filed 6/27/2007
    RFE 4/6/2009
RFE Received by Texas Center 5/13/2009 - Case is now pending
    EAD & SS# Received 5/2009.

My question is what would be my PD, would it be 7/31/2003 or 6/27/2007?
Currently at the Texas service center they are processing 8/30/2007.
I would like to try to figure out how long it has been pending for.

I have been reading these forums for a long time now just never really asked any questions.

Thank you to any answer to my question.

    Hi SeekLabor,
Best way to find out such information in a reliable way is to take an InfoPass appointment. They will tell you the most current information as the I/O will check the info infront of you.
    Good Luck.

ND - Notice Date, usually the date USCIS sent out the notice that your application was received.
PD - Priority Date, the date you filed your labor certification application or if LC was not required then the date you filed I-140 or in family-based case the date you filed I-130.

I think the majority would say that during the 'night" the first crescent is observed, it is counted as being day one, and a workday although most would not start their labor until sunrise.

    Does that help?
