    Charlotte AOS Interview

    Hello,

I had my AOS interview on 4/13/2006. Our interview was at 2:15 pm. We reached 45 minutes earlier. 20 minutes after 2:15 pm we were called in for interview. When she called our name I had gone to restroom with my 2 1/2 year old. She made us take the pledge and asked us to sit down. She asked for my and my wife's drivers licence. She also asked for my H1B visa and son's birth certificate. She then asked my wife few questions about her naturalization and whether she was married earlier or had children earlier ( both answer - negative). She then pointed to our son and asked if he was our biological son -Yes.

She then asked me question pertaining to I-485. Which I answered them. Since I knew the answer were NO to all criminal activity related questions, I promptly answered them NO. SHe checked off all the questions. She then asked for W-2 and tax refund for last year which I promptly gave. She filed copies of the requested documents. She then made fill out I-864A (it was already filled & submitted as part of our application) since my wife (sponsor) is a Housewife.

She then asked for our marriage certificate, she pondered over it, looked at it carefully and did something on her computer. We have been married for 5 years. Not sure.. .

Then, she asked for documents to show that we lived together, I submitted our credit card statement, bank statements, utility bills etc. She promptly filed them away.

Then she then mentioned that she hasn't made decision on our case . At this point we were stunned / nervous as we thought we would be approved (since it appeared to be a straight forward case). She mentioned that we would get the decision in mail. She then proceeded to ask us if we had any questions: I asked her if there was timeframe by which it would be approved but she wouldn't commit to an timeframe nor she would give anything more on what was the hold up (if they were waitingi for FBI back ground check or anything else). The whole interview was less then 25 - 30 minutes.

Does anybody have similar experience in Charlotte? Any recommendations on the next possible steps. Please Help

If you were married for 5 years...why did u wait that long to file for ur GC.Is it that u were waiting for ur wife's naturalization?
Did ur wife file for u when she was an LPR?

    Silly question
If PD was not current, the applicant COULD NOT have filed I-485 and hence there would have been no interview.

PD is a priority date, which in my opinion has nothing to do with your case, since your spouse is a USC. Just relax, in most cases an officer doesn't have authority to approve a case and he or she needs an approval from the supervisor , its just a formality and a normal practice. Same thing happened at my naturalized interview back in Sept 05. I didn't get approve as the supervisor was unavailable at the time , but the officer verbally told me abt the oath date and within 10-15 days I recieved an oath letter. But if were you I would make an infopass appointment and ask abt my case, atleast you might get an idea wat's going on with yor case.
BTW can you post your priority date??? As my spouse is also waiting for an I-485 interview(ours PD is Mar 7th 06).
    Thanks
    And keep us posted.

Where do I find PD on the letter? Does it have any relevance to the processing time for AOS or I-485?

MY fault, I should have explained "pd" in more detail, as I can imagine how these terms could confuse ???
Anyhow PD is your Notice date( which you can find on the first letter (reciept) you recieved from USCIS) and it is close to the date on which USCIS recieved your AOS application.and it has nothing to do with your AOS. PD is important for people who are waiting on behalf of their greencard holder spouses. They will be called in for interview only when their PDs are current. BUt again you don;t have to worry abt it
So could you pls tell me what is your NOtice date or if you don;t know it when did you sent your AOS application to USCIS????
    Thansk

    Thanks

How can that be possible? If sponsor is a LPR, or if you are not an immediate relative of a USC, you are not eligble to file I-485 till your PD becomes current. Are you applying through family or employment? In either case, I-485 has to be filed only after PD becomes current, so how come you filed your I-485 before your PD was current?

still... I-485 cannot be applied before PD is current. Did your case have any special processing??

Anyone here has any experience or heard of anyone filing I-485 and attending interview before PD becomes current?

I had a similar experience. Everything went well during my interview but unfortunately, I did not get a decision on that day and my passport was not stamped. The officer (he was not a supervisor) told me that I will receive my card in a few weeks but it has been about 3 months since my interview and no decision has been made.

My online case status currently states that "An interview was conducted in this case. We will mail you a decision as soon as processing is complete".

Please note that my I-130 was approved a day after my interview.

The Priority Date for my district office is May 2005 but my I-485 application was received on September 2005. Could this be a reason for the delay or is it something else?

I have made an infopass appointment for Wednesday to see if i can get some insight to what is happening. I will also try to get the name of the officer who interviewed me.

If I don't get any reasonable explanation then my next move will be to contact my senators and congressmen.
