Thread: Calculations correct?

  1. Calculations correct?

    Ok i want to schedule my Infopass for Tuesday down in delaware.

    I should have 92 days by then
    see if i am right, not sure if weekends are counted, or they don't count certain days, whatever.

    RD - Dec 27th

    Dec = 5 days consisting of the 27th to the 31st
    Jan = 31 days
    Feb = 28 days
    Mar = 31 days
    April = 11 days
    -----------------
    106 days

    Now an RFE notice date from the 13th and then an RFE reciept date on the 27 (which i spent 14 bucks sending overnight on the 14th )
    shaves off 14 days

    so now 106 - 14 = 92

    will they give it to me or did i go wrong?
    i only went to the infopass a couple days ago not knowing about the RFE thing and it was only like 85 days 30 bucks down the drain.

    Are you talking about getting an Interim EAD?
    What did you have to pay $30 for?

    I think you should be able to get your i-EAD now, it has been over 3 months.
    (If that is what you were talking about. If not, just ignore my post!!)

    yes! i am trying to find out if i am gonna spend 4 hours driving for nothing.

    oh and when i schedule infopass the offices i am shown closest to me, are they all able to give me the IEAD right there and then?

  4. I believe your calculation is ok and you should be able to get your iEAD same day but remember to take your notice date letter and atleast one form of photo ID which could be you passport.

  5. You have an RFE on the 27th of March?! If so, then you should count almost 90 days from then...which is bad enough for an infopass anyway....

    From what I read here, yes.

    If USCIS does not approve or deny your Employment Authorization Document application within 90 days (within 30 days for an asylum applicant; note: asylum applicants are eligible to file for EADs only after waiting 150 days from the date they filed their properly completed original asylum applications), you may request an interim Employment Authorization Document. You must go to your local USCIS office and bring with you proof of your identity and any documents that USCIS has sent you about your employment authorization application.     It never hurts to call the 1-800 number (1 (800) 375-5283) to make sure that you will be able to get your iEAD. Tell them about the RFE, too. Better to know for sure than to waste your time!

  7. I agree with icman, the RFE notice says that according to law blah blah blah, you need to count the 90 days from the day they receive the missing info asked in the RFE. I'm in the same situation, I can't really wait that long so I scheduled an InfoPass to see if I can count 90 days from the first RN and get my iEAD next. Please, let us know how it goes.

  8. I called the stupid 1-800 number, 1 girl tells me i gotta wait 60 days from the RFE date and another says i gotta take out the RFE receipt time and that i am eligable.
    Then she tells me i cannot go to the delaware Office because they won't service people from out of State ( i am in Pennsylvania) , yet my i-765 is handled by california and my i-485 is handled by chicago
    Can i go to delaware or do i have to wait ANOTHER WEEK to get a stupid iEAD From philly?
    (sorry i am not happy they have messed me around too long now i hate this living in fear)
    Delaware is a satellite office of the Philidelphia office she tells me, ANNNND? doesn't that mean i can go?
    Please help the 1-800 number just isnt helping me

    If the RFE does not concern the EAD, will he still have to count from the ND of the RFE? Or does the RFE always concern the EAD too?

    Token Ranger, I would definitely call that service number first to find out.

    Sorry, I should have warned you. Sometimes they seem not to really know what's going on. I have no idea what a satellite office is, either...
    Either try again and hope you will have someone more knowledgeable or make another appointment for Philadelphia. Philly is responsible for PA anyway. Won't it be closer for you, too?

    It isn't the point of being closer its the point of time, philly is always booked solid and i have to wait over a week to get to see anyone, delaware is never really that bad and you can get down there next day, so either its a week or more longer or 2 hours extra driving, i think i will take the 2 extra hours, its also a weeks wages lost because i can go back to my job i had before right away when i get my card.
    i am in a quandry here and i just found out the bank took some of my money for some inane thing and now i am overdrawn. i am getting broker and broker every day and i had to borrow money from my family to pay for the gas to go to delaware which i am now unsure of whether i can go or not.

    There's a bold paragraph in the RFE that I got that says that 'per law something something' you have to wait 90 days from the received date of the missing info asked in the RFE to ask for an iEAD instead of 90 days from the original received date. This can add months to the chance of anyone getting an iEAD.

    I guess the only thing you lose in going is time, so you should go. The infopass that I got is not till the 18th and I signed up for it a week ago. The wait is some DO's is really long. Just don't forget to bring all your notices. I'm guessing you had your FPs taken right? Even if you don't get the iEAD, at least you'll be able to speak to an actual immigration officer, unlike with the 800 number.

    Nah the immigration officer i spoke too first in philly took the 14 days out of the time and said that was all it came up short so she said very nicely "push off"
    the 1800 number too said the same thing the processing is resumed after wards it clearly sates that since prelimenary processing was completed it will take less than the stated 75 to 90 days.
    I should be at 106 so its really 92 days if you remove the 14 day RFE recieving time.

    Honestly, I'm a little confused. Token Ranger you said were counting from the overall RD. But payala says it would take up to 90 days from the RD of the RFE. That would be a catastrophe, concerning Token Ranger's situation.
    I can't imagine that that can be right, but obviously it's on payala's RFE.
    Well, as payala said, you don't have anything to lose, so drive down to Delaware tomorrow. You will also be able to speak to someone who knows what is going on.
    I wish you both good luck with the iEAD & hope you will be able to take that card home!

    thats what i was told and nowhere on my RFE does it say that about 90 days after the reciept of the RFE
    Anyway forget it i am going to delaware, i am so tired of this waiting around for them to do something.
    Oh and i figured out exactly what you should bring from the philly lady
    1. Evidence of application for i-485
    2. Passport
    3. completed i-765 application (they aksed me to fill it out in the waiting room)
    4.Copies of all the above and any id you have passport, DL, old card etc
    5.A smiley face and if they refuse 1000 dollars for a bribe
