    Stay legally in US till Oct 06

    Hi There

    I am a J1 student whose visa expires on june 4th 06 and whse DS2019 expires on 3rd July 06. My waiver is under process and awaiting clearence from DOS. I found an employer who would file my H1. I would like to know if I can stay legally in the US till the 1st Oct 06. Also I would like know if I can go for my stamping to Canada when my date is due or I would have to go to India.

    you can only stay legaly in the US till the expiry of your ds2019 plus 30 days of grace. Unless of course your employer has applied for h1b on your behalf and the approval is pending.
