    Are we approved? Confusing Notice from USCIS

    My wife and I attended her AOS interview on Monday at the Washington DC District Office. The officer told us he was going to recommend approval, but that all their cases are under review right now.

    On Wednesday we got a notice telling us that my wife has been scheduled for a biometric appointment in two weeks. The notice refers to the FD-258 status and has three boxes: New, Expired, Rejected. The Expired box is checked.

    At the bottom of the notice says, "If this appointment is not kept, your card will not be produced." Does this means her case is approved pending the new biometrics? The notice isn't a typical Notice of Action. There's no form number on it.

    My wife had her biometrics done back in April 2005, so I can't see why it would have expired.

    Has anyone else been is this position? We're not sure if this is a hopeful sign or an indication that USCIS is going to do a more thorough check that could hold up the application for a long time.

    here is my personal opinion.
    I think you wife is still on the pending list.
    there are two FP need to be taken, 1 for EAD and 2 FBI name checks.
    so if they ask you do it again, just do it. won't hurt at least, maybe they need you FP for name/background checks?

    there is no need to worry, with wut i have read, 99% cases like yours are approved

    Everybody most undergo for biometrics and fingerprinting. The FBI name check is regardless of your FP's so in my opinion has nothing to do with it. On your FBI name check they check if your name or alias are in many watch, terrorist list or wanted lists and other stuff, they must check in several databases sort of and unfortunately that takes time.
    Now, they need her FP's probably because they don't find that her FP's are still valid or something. As you said the note checked the box of "expired" then that's it. Even they were taken on April. But is nothing to do with the FBI name check. If that was the case, they would tell you.
    Chrisz, there are not two FBI name check at all. There is just a FBI name check and if your name came with a hit then you must wait, but nobody will know that until your interview when they tell you if that is the case.

    We went to the biometrics appointment but didn't see any updates for a week. The online status is now showing this:

    Application Type: I485, Application to Register Permanent Residence or to Adjust Status

    Current Status:

    On February 22, 2006, after approving your application, we ordered you a new card. Your card will be mailed to you as soon as it is ready.


    Works for me.
