Can Name check be expedited by a congressman?

Well.. as a last effort I have asked my lawyer to contact the local congressman to expide my name check with FBI. Congressman's office told that there would not be much to help with the case but would try.
Has anyone had any response Positivie or Negative from FBI as a result of query by congressman's office?

You may ask ur Attorney to send a request to USCIS to expedite namecheck if ur case fall in their criteria.

USCIS has advised the following FBI Name Check Expedite Criteria. One of the following criteria must be met in order for USCIS to expedite the check:

Military deployment must be imminent;

Age-out benefits (not covered by the Child Status Protection Act);
Writ of Mandamus--lawsuit pending in Federal Court;

Immigration Judge cases--grant of lawful permanent residence; and
Compelling reasons as provided by the requesting office (i.e. critical medical condition) assessed on a case by case basis.

So, if your case has been delayed solely for the FBI name check for an unreasonable period of time, check with an expert attorney about whether you may be able to expedite the clearance through one of the above means. We will update you as information becomes available.

If I interpret your answer,though one may contact Congressman, it would not be of much help.
One has to go thru the attorney to get the things moving.
I applied on EB2 and I am a Software engineer and I am not sure which one of the following criteria I fall into.


1. Military deployment must be imminent;

I am not eligible I guess.


2. Age-out benefits (not covered by the Child Status Protection Act);
Writ of Mandamus--lawsuit pending in Federal Court;



3. Immigration Judge cases--grant of lawful permanent residence; and

I believe cong/senator ppl would not helpful much in namecheck expedite, unless they see very geniune case. i.e 485 pending long and pastdue by USCIS processing date and namecheck still pending.

Do try and contact to cong.


2. you can use ur attorney to send letter to USCIS and ask expedite Namecheck, even no criteria ur case fall.

3. You can also send regular mail to Name check division directly and request them of status and expedite, if u are lucky u may see progress.

Compose 2 simple Letter (minimum lines) include your info like name addr phone, email, ur Alien #(impt), with requesting them to give the status or ur name-check, als tell them ur PD is 2001. and request them to expedite.

The congressman could not help further with expediting the namecheck!!

I have sent the letters by overnight with a request to expide and it appears like FBI is not even taking the letters.

This is exactly what happened to my last letter to FBI. I guess after been flooded with the letters, they don't even want to look at them anymore.

Don't send 'USPS return receipt req' and any courier who includes confirmation delievery service to the namecheck agency,

Use simple USPS certified mail, or simple mail.
