    how will they know you are doing moonlighting???

    my friend did moonlightings from day 1 of H1B and infact he submitted two W2's each year withtout any problem?
    my concern is I did moonlightings after 3 yrs of HiB and with EAD
    I guess I have to expect best???
    you are scaring me?

    It all falls under the category of 'lying to the goverment'.

    For your friend: If you have an H1b through one employer, but in addition you work on W2 for another employer, you are violating the terms of your visa. Chances are, you will get away with that without anyone ever questioning you, but a picky SOB at the I485 stage might go back through your employment history and pick up on it.

    There is nothing illegal about moonlighting per-se, from what you are telling us you stuck to the rules (holding an EAD, beeing past the required 3 years of 'pure' H1b status). So don't worry.

    You CAN moonlight during the initial 3 years, but you apparently need a second H1b. There are plenty of H1b's working 5/8 with the VA who have a 3/8 faculty appointment at the affiliated university hospital (universities don't fall under the cap, so it is easy to file a second H1b for them).
