Error on plastic card. Should I E-file the I-90??

After all that, we get our cards today, and my wife's birthdate on the card is wrong. Its off by 2 days. The CSR at USCIS says I need to file an I-90 with the Miami office, and prove to them that the application had the correct date by showing a copy of the original application, which it did, or else they will charge me $185 for new card. My lawyer told me to e-file the application for the I-90, and since its a service center error there is no fee.

Has anyone e-filed I-90 this with success, or is it better to fille a paper version?? I've heard that E-filing EAD applications just causes more problems.

Well, my journey is still not over.

Again back to my original arguement from another thread, if they didn't have to do all this duplicate work, they could save so many costs that eventually go to the taxpayer.

    Sorry to hear about it,

Paper file would be fine, get everyting in b/w and keep all proof.

carefully read the plus biometric fee.
Is it applicable in ur case?....

    "New Fee
    Base fee: $185.
If you turned 14 since your last card was issued, base fee of $185 plus a biometric fee of $70"

The lawyer told me since its an error, I shouldn't be charged.

When I called, the CSR told me I will need to show proof of the original forms to show that USCIS made an error and the I filled out the forms correctly, and so I won't be charged the $185 either.

Well I went through the steps to E-file, and there is in fact no fee if you selected the checkbox that you are filing because of a USCIS error.

Called to schedule an appointment for fingerprinting, and the lady said we could come tomorrow. But since we are going on a trip to visit the Great White North I asked for an appointment after the New Year, since they will take the card away at the fingerprinting. We need it to enter back into the US. The CSR warned us that we may have trouble entering on the card. I'll take my chances since, the birthdate is only 2 days difference (23rd instead of 25th) so its actually hard to notice. Scheduled the fingerprinting for the 1st week of January.

I'll keep you guys posted on our re-entry to the US on this screwed-up plastic card.

My other question is about renewing the driver's license. Since my wife was on a EAD, they only issued her driver's license until the expiry date of the EAD. Now if they take her card away, I know the DMV can use the I-551 Passport stamp, but will they only issue the Driver's license until the stamp expires? Anyone gotten a driver's license renewed in Florida using the passport stamp?

    CG,

You should not have any problems re-entering if you just show your passports, which I assume, have the I-551 stamps -- that you have already recd the plastic cards ought not to be obvious to the officer at the POE.

As far as the driver's license is concerned, visit the FL DMV's webpage -- it should list acceptable forms of ID for permanent residents seeking obtian driver's licenses.

ps. Belated congratulations on your approval -- I am generally around but too lazy to log in and post congratulatory messages.

    curiousGeorge,
I am in Florida. I did ask this question when I renew my DL recently (before my case got approved, had to because DL was expiring soon). The officer told me that unless you have your physical GC, they can only give you one year. So I would suggest that your wife renew her DL first then go for the FP.
