    I1-40 required documents

    week back I got approval for my labor. Could any one please list down the document I nedd to submit with I-40 form. I know I should ely on whatever my attorney is asking, but I would really appreciate if any one can list down the documents needed for I-140.

    With concurrent filing, you need the following documents.

    Copy of passport with copy of I-94(both sides).
    Copy of I-797 Notice of Action. It is an H1B/L1 visa status document.
    Copy of birth certificate.
    Six Immigration Photographs (2 each for I-485, I-131 and I-765).
    Note: These are immigration photographs and not passport photographs. They are also called ADIT style photographs. These photographs should be taken within 30 days of filing the application to USCIS.
    Copy of approved Labor Certificate
    Copy of approved I-140.
    Original Employment letter from the employer saying that the job is still available. It should be on the company stationary.
    Sample Employment Letter
    If applicable, the applicant must also submit copies of all marriage certificates, divorce decrees, death certificates (of former spouses), birth certificates of all children, and certified copies of any and all arrests and criminal court records.
    Finger printing fee $50 payable by check/money order to regional service center (e.g., USCIS-VSC).
    Any document not in English must be translated into English.

    I knew you from ATL DOL thread. Congratulations again.
    My case was approved on 2/4/04, but knew on 2/23/04.

    Question for you.

    are you filing I140 and I-485 concurrently OR semi-concurrently?

    concurrent : file I-140, I-485, EAD, AP at same time.

    semi-concurrent : fileI-140 and wait for receipt. File I-485/EAD/AP with I-140 receipt.

    I have choosen the CP option. Nothing reasonable, but just goign to gamble on my luck. If I win I woul dhave plastic card within 12 to 15 months (If I don't loose my job). Even if I go for concurrent and I loose the job b4 I140 approval (12 months now), I would be in same situation as in CP.

    so CP is better, simple and guaranteed option for me.

    what is ur opinion on this?

    Chances of keeping job/getting job is VERY HIGH for me if I have the GC or I-140+EAD approvals. So I want to be in that position by applying for I-140 + I-485 rather going for CP. Because I-140 itself taking close to year. And add 4 months for CP interview.
    If I-140 is taking more time, then atleast I can change job as soon as I-140 is cleared.

    As a matter of fact, I am still in confused state.

    I will post you next week with my decision.

    please post your final decision and your rationale behind it when you come to a conclusion about cp or aos. thanks.

    Prosix,

    I made a decision to go with I-485 instead of CP.

    Why?

    -- I have no doubt about CP processing procedure. I always have seen good feedback from CP green card holders. Very straight forward as long as you maintain good documentation and No-out-of-status record. Still is a good track to take.

    -- I choosed this path, as I am a consultant and willing to use AC21 just in case my project comes to an end.

    -- I am not worried holding GC in hand as long as project is going good with good money.

    -- If CP processing times reduces from 8-10 moths to 2-3 months, I may choose to go for CP after I-140 is approved usign AC I-140.

    If your job is permanent in nature and can withstand the financial conditions of the current market, I would say that your decision is RIGHT.
