140 is a employer application. They are proving that they are capable of paying you the salary that they listed in the labor application. Not sure whether there is a law that requires the employer to pay the application fee.

Ask your lawyer to send a letter requesting consolidation of A#s. I have seen on various forums where people with similar issues got the consolidation with lawyer letters.

There are two types of EB1 that may be applicable here: 1) EB1- Extraordinary Abilities (http://bit.ly/dophyK) and 2) EB1 - Outstanding Researcher(http://bit.ly/alNpBa) . The evidence requirements are slightly easier in OR than EA. EA is extremely difficult.
