But could this be a solution?
Well - Canadian PR requires to be physically present 2 years out of 5 years.
The US PR means you have to live in the US.
What if you have a job say in Seattle and stay in Seattle during the week. But you go to visit Canada on the weekend. Could this work...
I also wonder how a US citizen to be feels about his new country when he gets divorced from his wife after being seperated for so long?
How does a child feel when is seperated from a parent for so long?
Is that a good way to treat future US citizens?
I like a lot of things about the US...
I think this one of the most dumm laws out there. I am a citizen now. I had to bring my spouse on H1B - total stupidity. We met in the US and were married initially in the US. But we needed to travel - so this was the only way. We had to go through different booths as Seattle airport - total...
Actually I was on 2 trips that were almost back to back. One for 5 montths. Stayed in the US for 1.5 months and then went again for 3 months. As such total was 8 months. I did have a reentry permit but I never had to show it at the airport. But on US citizenship interview the woman in Seattle...
Remember that since INS loves you - then you can return a favor and just have the GC with you. And you will get rewarded with a smile from an inspector at the airport. It is such a lovely organization. So you would not want to do it if anything for the lovely organization that helps monitor you...
I read about a dude who did it right. Now he is divorced. It was hard to get through being on 2 different continents. The spouse could not visit him. He would sometimes go to visit her but what kind of a relationship it is if this goes on for say 5 years time......
But hey - now he is a US...
Also a good way is to consult a good lawyer. But I doubt he will shed more light then this group.
I would also try to avoid frequent B visits. Because the INS might start sniffing.
=========
I am not a lawyer and I do not provide legal advice.
Keep in mind that you can always do it the right way just like a good person for INS. You could tell your wife to sat to IO the real purpose of the visit. There would be very good likelyhood of having her put in handcuffs, put into detention to await the next flight back home.
But this way...
Once you marry someone in your home country you will get to know the real definition of your home in the US and you will love it. Basically you will find your spouse cannot visit even on B visa and if the country is on VWP - she should avoild coming to visit because INS in your new home can put...
Well - the company is not selling anything in the foreign country. But rather it employs engineers so that they can produce products that are then sold here in the US.
So the commerce is here in the US.
In the foreign country there are engineers that produce software, graphics etc.
Hello,
One of the requirements to be able to apply early is that the corp needs to be involved in some commerce - goods exchange between the US and a foreign country? Is setting up an office abroad that helps the US main office in development (software engineering) an ok reason to qualify for...
The key is also that INS can actually lock you up for hearing. This is the worst case scenario and not very likely - but one has to be aware especially if things are discretionary.
If they put you into a detention center - you get to see handcuffs put on you. If you have never been a...
My point still stands. The abandonment is a very relative thing. A person may have a valid reentry permit and maybe even on a temporary extended trip abroad but may loose the GC based on the fact that this is a subjective process and not an objective process.
Most people who have GCs...
I haven't asked the lawyer but following this line of reasoning - having a house in the US might also not help. Many people living outside of the US on a permanent basis have houses here.
Even a letter from company that this is temp employment outside will cause a stir............It does not...
Also my lawyer said that storing personal belongings is dumm and can work against you that you are trying sthg funny. Because it does not make sense to store say a mattress for 2 years because the amount of money you spend will be more than the value of the mattress. That is the problem...
Well - I said jail but meant detention center. They are very similar by the way. You have a cell and you are transported there in handcuffs. Lots of people get traumatized when they get this type of service courtesy of US govt. You do not stay in this detention center for a very long time - only...
Yes. I agree with all the answers.
BUT
As we know immigration system here is based on discretion. A person who was out of the US for 2 years even on valid reentry permit will likely cause a lot of stir from the immigration officers. Now let's assume you get an IO who is going thru some...
I am wondering if in this situation the person can keep GC.
One spouse is a US citizen. The other is a GC holder. The US citizen spouse decides to go on a temporary basis to another country to setup operations of a US company for 2 years. The spouse is just a GC holder - wants to stay with...
