Your Wife/fiance will need the AOS (noterized) when she goes in for the appointment. You will have to mail it to her. I personnel went to Ecuador for the appointment and gave it to her, we only had to show once. The consulate will also ask for $100, they will send the information to her in...
Thanks, I also found the info in the INS web site. I says you need both an approved I-130 and I-485. The I-485 is $300 and like you said, it takes a long time, INS says 2 years.
I have another question. The K3 visa is good for 2 years so does my wife have to go back to her home country...
Hi, I was divorced in Jun of last year and met my now wife while I was seperated. We were married in August. I don't think there is a minimum time to wait. My wife got her K3 visa and the consulate didn't have a problem with the 2 month time span between my divorce and marriage.
Besides...
I totally understand your frustration. I filed my I-129f on 25 Oct and it was finally approved on Valentines day. My wife's appointment was 2 months after that. There has to be an easier way. Good luck and hang in there. I know it's horrible.
Does anyone know if you have to submit an I-485 to adjust the status of a spouse after the K3 has been approved or just wait for the I-130 to be approved?
I don't know if this is a possibility but maybe you can go down there and get married before this other guy does. Legally there is nothing the our government can do. Have you tried talking to her father?
Thats a very difficult delema you have. I hope things go well for you.
It took me about a week to get my I-797. I think it will be quicker for you to get the K3 and then submit the I-765. (It takes about 5 or 6 months for the K3). I'm not sure how long work approvals take, probably 3 months.
I found these figures on the INS website
http://www.immigration.gov/graphics/formsfee/forms/i-864P.htm
They are good until April 1 so you may want to check them after April 1st. I'm not sure if tax is included or not, you may have to ask the INS that question.
I have no idea. I think the INS goes off of your annual income. I think they require 125% of the povert line which for 2002 is as follows:
House hold - 125% of poverty line
Size
2 - $14,925
3 - $18,775
4 - $22,625
