Would like to know how to maintain lawful status while I-140 petition is pending?. I petitioned for I-140 EB-NIW October 2007 and no answer yet. The issue I have is that my E-2 Visa status is close to expire. Does anyone know if having a pending case maintain you on a lawful immigration status after original visa has expired?, if not what to do?
