Are you a GC holder or have you applied for GC?
If so, this a possible cause for rejection. A J1 entrant is not supposed to have
immigrant intent.(unlike an H1b for example) You having applied for permanent residency may have prejudiced your wife's application if she had indeed mentioned that...
Hi guys:
Our lawyer(for J1 Waiver through Conrad 30) is of the opinion that we don't
need to get attestation from the Indian Govt(Dept of Home, DoE etc)
if we didn't receive financial/travel assistance from the GoI. (We did not)
However IndianEmbassy.org seems to indicate otherwise...
All:
My wife has obtained a J1 Waiver position, hopefully next summer
if she gets the waiver.
After not having been to India for the past 6 years(Res + Fellowship),
she'd like to visit India for a month after she gets an H1 approved.
Two questions:
0. Is this advisable? Is there a...

Hi
I'm a J1 physician, who would like to travel to India after
a 3 years. My husband is on H1(7th year), with Adjustment of
Status(to Immigrant) pending.
We both have to revalidate visas, with interviews now being mandated.
I'm not on my Husband's AOS/GC petition.
The problem...

Thanks for your reply. I did get my 7th year petition approved.
Apparently, you may file for H1 extensions even if are filing/filed an I-485(provided you don't have your EAD yet). This is called
the 'dual intent doctrine'(i.e both an immigrant & non-immigrant petition).
Anyway, I...

Thanks much, obsoza for your reply.
My main concern was does mere fact that I file my I-485,
allow me to stay in employment even if my H1 runs out,
7th year petition is not approved(because of I-140 approval
and I haven't got the EAD?
Thanks again
Hello:
My I-140 got approved on 3/31/03 as per the INS web site;
and my company's law firm filed an H1-B extension for the 7th year on (4/1/03), premium processing.
At the time of filing, the I-140 approval status(apparently)
was not known by the law firm.
My 6 year term ends on June...
