H-1b extension has to be submitted 1 year before 6th year expiration or it has to be pending for 365 days or you have to have approved LC before.

Yes, I did. Just got the appointment for biometrics for May20th. I wander how much time to approve I-485 once biometrics is scheduled.
Chronology
I-140/I-485/I765/I-131 filed concurrently 4/17
EAD received 4/23
biometrics appointment 5/20
all under EB2 (area of chargeability is "other"...
If your H1b is expired and you have not submitted an extension, but have approved I-140 and valid EAD can you continue working for the present employer?
In other words is valid EAD alone sufficient to work for employer despite having expired H1-b status?

Problem is I am legal until 05/17/09. I know that you can stay in the country once you file I-485, so if I send it in earlier (in anticipation of current PD) would that buy me some time from may to july....?
