Hi,
I am a F-1 student who is marrying a US citizen next week.
My wife is about to graduate soon but hasn't find a job yet. Therefore her parents are going to be my sponser (joint sponser? got really confused by those terms)
The family size is 6 people plus me = 7. Under I-864p, the mimimum required amount is 37,750.
Her parent has income together as 43,500 for the 2008 tax return, with the average of 3 recect years tax income, each of them shared 50% which is around 21,000 pre person.
I am a graduate teaching assistant with income of 21,000 with no dependent

My questions

1. My wife has to be the sponsor to fill out the I-864 form for me. Since she is not graduating until Dec., she has no income yet. Therefore, each of her parents will have to file a I-864a for us. Question is, for the I-864 form that my wife has to fill out, which box will she need to check on the first question. Check D as "the only joint sponsor"? or she will check A as the petitioner?

2. Do My parents in law just need to fill out the I-864a each only? Will they need to fill out any I-864 form as the joint sponsor? or just to need to fill out the I-864a form as the promise from her relatives.

3. Household size. If the case is my wife fill out I-864 (with 0 income), her parents filled out 2 I-864a. In my wife's I-864 form, does she put me, herself, and her parents as 4 in total household size? or we have to take her 3 other siblings into account as 7?

4. I am very confused about weither one of her parents should be the "joint sponsor" and need to fill out an I-864 form as well or not. Of course, simple as it can get could be just the previous solution.

Thanks

Greetings. I've seen a number of posts similar to this but not quite in line with my scenario.

My wife was approved for a GC in April 2008, meaning we should file in Jan 2010 for the removal of the condition on the card. I'm a US citizen. However, we're considering a divorce. A couple questions:

1) If a divorce petition is filed prior to the filing of the request to remove the condition, what is the impact? Does this cancel the whole permanent residency application? Neither of us would be able to tell a USCIS officer in an interview that we were together or intended to stay married.
2) Is it possible for me, as the sponsor, to just cancel the application for permanent residency (and/or affidavit of support) prior to the filing of the petition? If so, what's the implication to her - does she need to immediately leave the country, would she have time to try to get her employer to sponsor her, etc? I'm seriously considering this route, should it exist, due to the state of the relationship.

Any help you all can provide would be appreciated.

Hi ,

We sent our documents 2 weeks ago and I was waiting USCIS to cash our check. However, yesterday they sent us our documents back and they said that the amount of our check is wrong .

My wife was here with J1 visa ( au -pair and no 2 year requirement) and I am a US citizen. We worked with an immigration attorney . He told us to prepare the following forms :

I-130
I-485
G-325A
I-693
I-765
I -864
6 Passport pics for my wife , 2 passport pics for me
Last year w2 , tax returns
Birth certificate
Copy of her visa
Copy of I-94

I made a mistake and send a check for $1345 .. I believe it should be $1365 .. $355 for I -130 and $1010 for I-485..

Now, they sent three notices of rejection that our check is wrong amount . My question is one notice for I-130 that it should be $355 , one notice for I-485 $1010 . But , also the third notice says I -765 for $340

I believe $1010 for I-485 covers also for I-765 right ? Should I fill all the forms all over again to be on the safe side or send them the same forms that has already been filled ? Also, is it better to send 2 seperate checks for I-130 and I -485 or 1 check for $1365 ?

I do no know how I made this stupid mistake but instead of writing $1365 , i wrote $1345. I hope this mistake will not effect our interview process and also I guess i am lucky that they did not cash the check ..

the only issue is that we dont live together. We had our Court marriage in July of this year and we plan on having a big wedding with family and friends in Pakistan in July 2010. until then i will continue to live with my parents and my husband will live in a different state where he works and goes to school!
so my concern is whether or not the different addresses and our current living situation will cause any problems or delays in his application process!!!

Also my husband can not travel out of country as he does not have a visa only the status.
