			<description>My I-140 got denied on May 16 2013. I have yet to receive the notice from INS, however, I believe the notice will be mailed to the lawyer/Employer which in my case both have neglected any kind of response. Kindly advise any options I may have available at this point.

Should I appeal or apply in EB3.<br />

Here is the denial reason:<br />

According to the ETA 9089,filed the requirements for the position of a systems analyst are,at a minimum, a bachelor's degree in computer science,math,business or engineering in addition to 60 months of experience in the job offered. How ever, in section H14,of the ETA 9089, there was an alternate level of education experience listed. Specifically, the labor certification states in H.14. &quot;Bachelors degree equivalency may be met by combination of degrees&quot;. Since the labor certification would also allow for the combination of education, such as multiple degrees, the ETA 9089 does not meet the classification of an E21,a member of the professions holding an advanced degree or an alien of exception ability.</div>

			<content:encoded><![CDATA[<div>So I have been working at this company for 4.5 years. I have an H1b which will expire in October of 2013. I got my PERM approved, but I finally understood that I can't apply for I-485 unless my priority date is current (my pd is 12/12/2012). So I don't see the point of applying for the I-140. <br />
<br />
I have multiple courses of action and I would like your advice<br />
<br />
A. I can apply for the I-140 , renew my H1b and wait for my priority date to be current. or hope the immigration reform will ease the EB3 backlog.<br />
<br />
B. Wait until next year and redo my prevailing wage, PERM and I-140  under EB2. <br />
<br />
C.  Wait for immigration reform and apply for an adjustment of status with everybody else who is illegal.<br />
<br />
D. Wait for immigration reform and apply for Asylum since they will lift the 1 year restriction on Asylum applicants. (I have a valid case, but I passed the 1 year limit ).<br />
<br />
I've been in the US legally since 2003, and I am just getting pretty frustrated with how long this process is taking. I would like your recommendations. <br />
