AS per the blogs I should be qualified for EB2. But not sure why my case is denied. I am thinking my case was not represented correctly. pls advise how to proceed. Should I appeal or apply in EB3.

Here is the denial reason:

According to the ETA 9089,filed the requirements for the position of a systems analyst are,at a minimum, a bachelor's degree in computer science,math,business or engineering in addition to 60 months of experience in the job offered. How ever, in section H14,of the ETA 9089, there was an alternate level of education experience listed. Specifically, the labor certification states in H.14. "Bachelors degree equivalency may be met by combination of degrees". I have an H1b which will expire in October of 2013. I got my PERM approved, but I finally understood that I can't apply for I-485 unless my priority date is current (my pd is 12/12/2012). So I don't see the point of applying for the I-140.

I have multiple courses of action and I would like your advice

A. I can apply for the I-140 , renew my H1b and wait for my priority date to be current. or hope the immigration reform will ease the EB3 backlog.

B. Wait until next year and redo my prevailing wage, PERM and I-140 under EB2.

C. Wait for immigration reform and apply for an adjustment of status with everybody else who is illegal.

D. Wait for immigration reform and apply for Asylum since they will lift the 1 year restriction on Asylum applicants. (I have a valid case, but I passed the 1 year limit ).

I've been in the US legally since 2003, and I am just getting pretty frustrated with how long this process is taking. I would like your recommendations.

My attorney told me that because experience is not needed for the position, section K about "Alien Work Experience" can be left empty.
The occupation title is : computer and information research scientists, SOC: 15-1111, Level I
I was told by the attorney that for this occupation title no experience is needed.

Is that so?
