I am a college student with an F-1 visa. In September of 2012, I received a charge for possession of marijuana by a driver, a misdemeanor. I was not arrested but I was field released which I believe is another form of arrest. Now I have a charge and an arrest on my record. When I went to court, we asked the judge for a non-adjudication and he granted it. This meant that he would hold my guilty plea and if I followed certain conditions he would not accept my plea and remove all the offenses off my record. These conditions were to report to six months of supervised probation and attend a first time offender's class all in addition to paying a set of fines. Since then I completed my probation, took the class and paid off all of my fines. I have filed for a motion to expunge my records and I have a good feeling the judge will sign it and I will have no record whatsoever. The issue is that I am planning on leaving the United States in less than a month. I have talked to the court clerk and he said that if the motion was signed, my records would be expunged from four different agencies, including the FBI. The problem is that he says it may take the FBI anywhere from one week to a few months to expunge my records. I will be renewing my F1 student visa in Kigali, Rwanda and I have already been in contact with them regarding my return. I have filled out the DS-160 form and submitted it to them. All I need to do is be there for the fingerprinting and show a few additional documents including my academic transcript, which has been nothing but As and Bs. An extra piece of information is that I will be transferring to a different university when I return. I have gotten my acceptance letter and I will go back with the I-20 that belongs to the new school. If I can have my records expunged from all four agencies in the next three weeks, there will be nothing from stopping me from leaving the United States. However, if one of the four agencies delays the process of removing my records, I will strongly reconsider leaving the country in the first place. Or should that not be an issue. Lastly, I know the consular personally, does any student applying for renewing an F1 visa automatically qualify for a background check or will showing my academic transcript be sufficient. Any additional advice would be much appreciated.<br />

My husband is in the US and is in the F-1 CPT (he is doing his PhD). We have been married for 6 months now and I am thinking to apply for a F-2 visa because he is going to take time to complete his studies. I had applied for a B-2 visa(before marriage) to visit him in the US a year back but was given 214(b) instead. So I am little reluctant to apply again after that rejection.<br />
<br />
I work in an IT company and have a good qualification. Probably the reason they rejected my visa earlier. I want to apply for an F-2 visa since we have not been able to stay together since our marriage even for a week, so I have planned to take a sabbatical from my company to go and visit him. Also he is alone and we have no family there so just want to support him for a couple of months. <br />
<br />
What should be my plan of action? Should I go for F2? Or should I go for F-1(already has an admit but in a different US state as my husband so I was not sure to go for it) for spring semester? F-1 is an option for me since we will be able to see each other atleast once a month.<br />
<br />
I would be very grateful if anyone can help me out!<br />

I spoke to my DSO about applying an OPT and he told me i could apply after my last day of class or wait until my graduation date. After going thru him over this, he mentioned i would be in status and could apply for my OPT after i graduate. My class ended in january and my graduation is in May of this year. During this period i was studying for a certification for microsoft by my self. I did not attend any class as my program was completed and was just waiting for my graduation date to apply for my OPT.<br />
My DSO then left the job in school and i went back to speak to another DSO in the school right after my grad date and he told me that i have passed my 60 days period to apply for an OPT and at the same time my SEVIS has been shortened and i am out of F-1 status. I argued with him that the other DSO said everything was okay, he said it was not. <br />
SO he has asked me to apply for a i-539 to reactivate my F-1 visa so i could apply for an OPT. My visa has expired on my passport and my passport is current, and i-20 will expire on the first of June of this year. During my time i did work in a convenience store and sold beer to a minor :( which was a huge mistake. The case was dismissed by the state and it has been almost 6 years. In the i-539 it mentions to specify any criminal offense. <b>Should i mention this or not, because if i do, i am 100 percent certain i have violated my student status. If i dont mention will they find out?</b>. Does anyone has success in reinstating F-1 Visa just for applying an OPT.<br />

First of all, thank you for your time.<br />
<br />
I am international student on an F1 visa. I have been charged with a 3rd degree felony - False Imprisonment, it was a rough night. The case is still pending at federal court, charged, but not indicted. I am an outstanding student according to the testimony of my adviser and my supervisor, also I have no criminal history. It is a total misunderstanding, but I guess I really should be cautious next time if someone wants to set me up... <br />
<br />
DA think what I did is not a 3rd degree felony crime, but somehow, he felt I did something wrong, although he couldn't tell what is wrong, which is understandable, cause at least I am arrested by police. That's why he doesn't want to dismiss the case right now. He is considering to dismiss my case right before I get graduated. <br />
<br />
Being alone here, I am really having a tough time. Now I am thinking to go back home for couple months, probably spending some quality time with my family will help me get over it. I will continue my research oversea, get my F1 visa renewed and come back US for graduation. <br />
<br />
I have two questions here: <br />
<br />
1. Can I get my visa renewed, when I plan to come back, if the case is still pending? <br />
2. What if I wait until the case is dismissed, can I get my F1 visa renewed at that time? <br />
<br />

I've made a bad trip plan. Now I'm in a bad situation here. <br />
<br />
I'm a graduating F1 student. My latest I20 expires on 18th of May. I just submitted my OPT application today so I don't think i can get the receipt notice before my I20 expires. I've made a travel plan to Mexico. My question is if I travel to Mexico, am I be able to re-enter US on the 17th of May (last day before i20 expires). Another question is if my receipt arrive to my US address. Am I be able to re-enter US with a <b>photocopy</b> of the OPT receipt notice after my i20 expires?<br />

 My situation is different here. I graduated in Dec 2011, got my OPT from Feb 2012 and completed it on Feb 2013 ( 12 month since I had a MBA background). I returned back to India right the next day since I wanted to be home for good.<br />

My F1 Visa from my Univ shows that it is valid till July 2013, I spoke to that University from India and they said I could do courses if I wanted to in their University and they would issue me an I-20, my question for you all is <br />
<br />
-  Can I return to US with the same old F1 Visa which was valid from July 2008 to July 2013? Or do I need to apply for a fresh new Visa? My Visa states the Same University which I can get an I-20.<br />
<br />
Another question is, my passport expires next year, what can I do for applying for a passport from US incase I get to enter..<br />

A person in our international student center told me that i can travel to India if i get that receipt from USCIS ( even if my OPT application is pending ). I have a job offer and i am waiting for my OPT to join. Is it safe for me to travel to India while my OPT application is pending ? If So, what are the documents i need to carry with me ? <br />
