Hello...

I was recently issued a 10 year multiple entry visa. I'm a canadian permanent resident.

My family initially planned to go Seattle for vacation for Canada day on the 1st of july. but has decided to fly to Florida instead and go for a cruise.

In our DS160 application, we indicated that we are going to seattle. now we want to go for a cruise to Bahamas and stay in Miami & Orlando for a week.

Can we do this? do we need to travel to Seattle first since it's on our DS160 form? or it's alright to visit Florida?

Thank you

I am an employee of a US based MNC in India. I had a valid B1/B2 visa with multiple entries valid for 10 years. I visited US for a business trip back in August 2010 and was given i-94 with six months stamp. Due to business reasons and due to my health reasons i returned back to India in Jan 2011, i.e 5 and a half months(less than the allowed 6 months). US Embassy in India contacted me after 1 year and 2 months asking me to submit my passport. When i visited the embassy they asked me the reasons of my stay extending 5 and half months. I tried my best to explain but the embassy cancelled my existing visa under Section 212(a)(6)(C)(i) because they suspected that i was working on B1/B2 which was not the case. I have emails with me in which i have been asking my company to arrange for m return with the oncern that i do not want to stay too long. My company replied that their attorney has advised not to worry and stay there till 6 months as per port of entry.

After 9 months, i appeared again for the B1/B2 interview on 8th January 2013. This time again the interviewing officer asked me why is stayed for 5 months. She would have listened to me for 5 seconds and before i could finish she interrupted me. This time i was rejected and reason given was 214(b).

Now my company filed a H1b petition for me and told me it was not selected in lottery. I do not know how to make sure if they actually filed it for me. They forwarded rejecton letter to me but that does not have any applicant details.

Can i ask for some specific document that confirms they filed a H1b petiotion for me?

I am very specifically looking to understand what next step i should take.

a) Should i represent my case to embassy again through some attorney(writing a letter to them explaining the purpose of my stay being 5 months). I have a letter from my US client and my company specifying why my stay was for 5 months. i have some medical bills with me which show that i got sick in US. I ave some more supporting documents which i can show to the embassy.

b) I also met a consultant who assures me of getting this corrected(getting me a new B1 visa) through his links in embassy if i pay his fees. Yes, it sounds dubious to me as well, that is why i have still not used his services but do not see much options now

c) I can ask my company to file L1b for me, but my company is not too inclined for the same as they recently got a couple of rejections for L1b.

d) Can i expect some compensation from my company, legally or otherwise

I am just thinking about all the options that come to my mind, some of these might sound absurd but this is why am posting here, to know what i can do now.

Looking forward to some comments.

My wife (Canadian Citizen) and I applied for NEXUS yesterday.

I am a citizen of the Netherlands. In 2007 I got turned around at the POE in Florida - they believed I was living in the US on a B2 visa so visa was cancelled and I got turned around.

I didn't attempt to return to the US for 5 years. I am now a Permanent Resident of Canada, and was issued a new 10 year B2 visa at the Ottawa Embassy.

During the Visa interview, the officer informed me that I had an overstay recorded. He said not to worry about it, but gave me the dates they had on file.

When I went home, I looked up my email confirmation for the flight I took to leave the country. It appears that USCIS never recorded my EXIT on May 9th, 2007. My Entry Stamp was valid till May 10th, so I did not overstay.

Instead, they recorded my exit as May 14th, which was the day I got turned around, upon RE-ENTRY to the US. I had been gone already for 5 days!

I voluntarily withdrew my application for entry and my visa was voided. Is this in itself grounds for not approving NEXUS?

If that part can be overcome, then the only thing I am concerned about is that I have an incorrectly recorded overstay on record. How do I prove that I didn't overstay? It was 6 years ago now. Martinair no longer offers passenger flights, and when speaking with a KLM customer service rep she informed me their records don't go back to 2007 so she's not sure if I can even get confirmation that I boarded that flight.

I don't have any credit card statements or anything that could prove my presence in Holland for that period. Obviously as an EU passport holder there are no passport stamps stating I entered The Netherlands.

The only thing I have is a flight booking confirmation from CheapFlights, as well as a rental car booking from the same site. I have photos taken during that period too, but no way to prove those weren't taken in the US, nor are they date stamped.

Would proving I did not overstay make me eligible for NEXUS? Or was the fact that my visa was cancelled at POE completely preclude me from it anyway?

I have, since obtaining a new Visa, entered the US for day trips twice with no issues. The only reason we want NEXUS is because waiting almost 2 hours for an I-94 just to cross the border for dinner or some shopping is ridiculous.

In 2.5 years I'll be a Canadian Citizen and crossing will be quick and easy again - but if we can enjoy border crossing before then by having NEXUS, I know it'd certainly improve our quality of life, as we frequently want to cross the border but decide not to because of the hassles.

My husband's employer called him into the office last week and told him that he cannot afford to keep him anymore. My husband is an H1B visa holder and we are here on an H4.This came as a shock to us. We have no income as I am not allowed to work and we do not have family here in the US. Our children have settled in so well and we would like the opportunity of staying in the US. We panicked and contacted an immigration lawyer who advised is that if the new RPI bill is passed, we do qualify...it seems. what is confusing is that some parts of the bill states if you entered ILLEGALLY and some parts state if you entered legally but is now out of status. It is the Registered Provisional Immigrant Status (RPI). It is a 10 year path to citizenship and we fit all the requirements. Is there anybody else on the forum who would know more about this?
