<br />
I am GC holder. I overstayed 6 months outside of the USA due to 2 main reasons: 1)I met a woman and got married, 2)health problems. I did not plan to overstay, and never ever planned to abandon the USA but I had to overstay due to reasons above. I definitely will not be staying 1 year, I'm planning to go back soon<br />
I entered the USA in September 2006, left in May 2008, came back September 2008, again left May 2009, hasn't come back yet.<br />
I really worry now that I will have problems with naturalization. Some people say if you overstay 6 months the time resets and you again have to wait for another 5 years to apply for citizenship. Others say if you have mailing address, bank account, credit card, drivers license, filing taxes (all of them I do have) you should not have any problems when applying for citizenship.<br />
I could not find anywhere the exact law regarding my situation so I need an advice from the person who REALLY knows about it.</div>

I recently moved to NY state and am having trouble with the DMV. They want my SS name to match my GC name. I was planning to change my name during n-400 process (4 yrs away still) but  I am forced to do that now. <br />
<br />
I am assuming that first place to change will be the Indian passport, then GC then other cards.<br />
Any problems one can foresee with this? Is there a better way to do this? Also, does USCIS accept the passport name change as proof enough, or do I have to also go with a court order?<br />
<br />
The name I am going to assume will essentially be my passport name minus my dad's name. All my educational records are already based on my shorter name.<br />

b) What are my options to being able to legalize my status in the US ? <br />
c) Can anyone on the forum recommend a good lawyer in the Houston area ? <br />
I have spoken to 2 lawyers. One advised me to leave the country, as I had no options. The second said due to my past charge they said it will eventually end up in deportation. The only hope, if I stick around, is some changes towards immigration reform in the senate. I believe the last amensty was 1984, so I shouldn't count on that .. <br />
d) do you have a list of questions that I could ask a lawyer, I feel that I am missing something very importantly, and am torn between leaving my family behind in the US and returning to India or, continuing to stay illegally in the US<br />

My mom sent in five months earlier than my dad. She got her fingerprint appointment soon, and on that date after fingerprinting, she got her temporary 1 year green card with 10 year green card coming by mail 3 month ago. <br />
<br />
My dad sent in his I90 2 month ago. According to the USCIS website, they accepted our fingerprint fee on August 31, 2009 an mailed us a notice. We got the notice from the USCIS about the receipt of I90. However, since then, there is no progress. We haven't receive any other notice and when I check my dad's status online, it's still on acceptance. I tried contacting the USCIS by phone but I couldn't get hold of a person because of all the automatic responses.<br />
<br />
We don't know if we just have to wait or if there's a way we can find what's going on.<br />

Could someone give us an advice?</div>
